What about FOCA? FOCA is the Freedom of Choice Act. We are hearing from many major pro-life groups about FOCA these days. Here are a few examples. From LifeNews: "It would not only make unlimited abortions throughout pregnancy a national law but it would overturn the Laws in all 50 states designed to reduce abortions." From Americans United for Life: Denise Burke, AUL's Vice President of Legal Affairs calls FOCA "a radical attempt to enshrine abortion-on-demand into American law." Fight FOCA has a petition to sign. There are postcard campaigns, fundraising campaigns, etc. So what about FOCA? We believe that the Constitution of these United States is clear, as are the Constitutions of the individual States.  One of the purposes of the US Constitution is to "secure the blessings of liberty to ourselves and our posterity ". Our posterity is our children. The murder of innocent children (or adults) is never allowed. Article VI then states that "This Constitution , and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the Supreme Law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or Laws of any State to the contrary notwithstanding." A "law" stating that abortion is legal would never be made "in pursuance" of the Constitution . How could it be? It would be in contradiction, not in pursuance. Therefore, the Freedom of Choice Act would be not-law.  We propose that FOCA should be ignored, just as Roe should be ignored. |
